Bankruptcy Is Not What You Think It Is

  • Isn't debt consolidation just as good as bankruptcy?

    While on the face of it, debt consolidation can seem like a feasible way out of debt, the reality is that debt consolidation companies can do little to stop creditors from carrying out business as usual. For instance, debt collectors are still allowed to harass you and even sue you, even if you are making payments to the debt consolidation company.

  • Won't everyone know that I have filed for bankruptcy?

    Unless you are a celebrity, your bankruptcy will not show up in any magazines or newspapers. Yes, your bankruptcy in on public record in court, but who is going to search for your record in court? Only creditors will be aware that you filed for bankruptcy. Your friends, family and acquaintances shouldn’t find out unless you tell them, but even then, bankruptcy is now seen as a rite of passage, and not the shameful thing it once was.

  • Doesn't bankruptcy ruin your credit permanently?

    No, it doesn't. Bankruptcy gives you a fresh start, and you can build off that almost immediately. If you are careful, you can get your credit score into the 700's within just two years.

  • Won't the bankruptcy trustee sell off my property?

    In the Central District of California (which is where you would be filing), less than 1% of Chapter 7 bankruptcy cases have assets sold during the process. This is mainly due to the fact that California has rather generous exemptions that let you protect many of your assets, if you plan carefully with your bankruptcy lawyer.

  • Isn't it hard to file for bankruptcy?

    No, most people qualify for Chapter 7 bankruptcy and almost everyone qualifies for Chapter 13. California’s higher than average median income and our large mortgages make it likely that you will qualify. Southern California has the highest rate of bankruptcy filings in the country.
